  • (ii) to process and contact you regarding your project submission;
  • (iii) to reply to your messages and follow up on your event registration.

3. Reasons for treatment

4.14. The grounds on which we justify the processing of your Personal Data are: your consent when you participate in the interactive features of the Websites (e.g. by registering for an event), an overriding private interest when we reply to your messages received via the contact form, you create an account in order to submit a request to us, we process your project submission and contact you in connection therewith.

5.1. This Privacy Policy does not cover how your Personal Data is processed by third parties when we link to their websites. We encourage you to read the privacy policies of the other websites you visit.

5.4 Clinique Matignon Suisse SA maintains pages in the social networks Facebook, Linkedin, Tiktok and Instagram. We regularly publish and share content, offers and product recommendations. Social network operators use cookies and similar technologies to record your usage behavior whenever you interact with our fanpages or other Facebook or Instagram pages. Page managers have access to general statistical data on the interests and demographic characteristics of Internet users consulting a page (e.g. age, gender, region, etc.). When you use social networks, it is primarily the operators who define the type, scope and purpose of data processing.

5.5 The social networks Facebook and Instagram are both maintained by META Ireland Ltd, 4 Grand Canal Square, Dublin 2, Ireland (“META”).

Insofar as you communicate directly with us through our fanpages or share content with us, Clinique Matignon Suisse SA is responsible for processing your data. An exception applies to the processing of data for the purpose of analyzing usage (“Page Insights”), a situation described below. In such a case, we are jointly responsible with Meta

5.6 Processing of your data by Meta

Please note that Meta also manages your data when you use our fanpages for purposes that are specific to META, which this privacy policy does not cover. 6. Online advertising and retargeting

6.1. Our websites and apps contain cookies and similar tracking technologies from advertising partners who operate an online advertising network. Thus, our advertising partners may also capture your terminal and access data and present you with personalized advertisements on other websites and in apps, even managed by other providers, tailored to your interests (e.g. advertisements based on the pages you have consulted on our website).

6.2. We use Microsoft Advertising (Bing Ads), an online advertising service provided by Microsoft Corporation. 8. Disclosure of your personal data to third parties

8.1. We may provide access to the Personal Data you have provided to us through our Websites or our social media pages to certain independent contractors and affiliates so that they- assist us in operating said Websites or social media pages. To date, these contracting parties are as follows:

8.2. We take all necessary measures to ensure that your Personal Data is processed securely and in accordance with this Privacy Policy and applicable laws. All of our contractual partners are committed to protecting Personal Data using procedures similar to ours, unless otherwise specified in this Privacy Policy.

8.3. The purpose of sharing your Personal Data with the aforementioned third parties is to conduct our business, as well as to maintain and continually seek to improve our Websites and the services we offer to our users. Thus, the legal basis for this processing is our overriding legitimate interests.

9. Communication of your personal data to the authorities

9.1. We may disclose your Personal Data (including your communications) if we believe it is necessary for security reasons, to investigate a potential crime or any other violation of this Privacy Policy, and/or to prevent harm that could be caused to other users of our Websites or our social media pages. 11. Transborder communication of personal data

11.1. If, due to certain services provided by third parties, we are required to transfer your Personal Data to one of their databases outside the European Economic Area and/or Switzerland, potentially to a country that does not provide a level of personal data protection comparable to that prevailing in Switzerland or the European Economic Area, unless otherwise provided for in this Privacy Policy, we are committed to entering into an agreement with the third-party service provider to ensure an adequate level of protection for your Personal Data.

11.2. In particular, the use of Microsoft Advertising (Bing Ads) may involve the transfer of your Personal Data to the United States. This transfer is governed by appropriate safeguards: Microsoft Corporation is certified under the Swiss-U.S. Data Privacy Framework, which is recognized by the Swiss Federal Council as ensuring an adequate level of protection for personal data transferred from Switzerland. As a backup measure, Microsoft also relies on standard contractual clauses to ensure the protection of your Personal Data.

12. Protection of your personal data and notification of a personal data breach

12.1. We undertake to use all commercially reasonable means to prevent any exposure or disclosure of your Personal Data. In particular, we implement and maintain measures (including administrative, physical, and technical measures) to address instances of unauthorized disclosure or exposure of your Personal Data.

12.2. In the event of a confirmed or suspected breach of Personal Data, we undertake to (i) use our best efforts to notify you without delay, when technically feasible and (ii) cooperate with you to investigate and resolve the breach in question, including, but not limited to, providing you with reasonable assistance in notifying affected third parties of the incident. We undertake to give you access, without delay and within the limits of a reasonable request, to our files relating to the violation of your Personal Data, provided however that this does not give you access to files which belong to other users or which could compromise their security.
