General Sales Conditions (GSC)

Article 1 – Price of an e-consultation and payment

• 1.1 – Any person placing an e-consultation order on our site declares that he or she is 18 years of age and has the legal capacity or, failing that, parental authorization to enter into the contract.
• 1.2 – The price of an e-consultation is fixed, and is indicated in CHF, VAT included, it corresponds to a consultation time via Facetime limited to 20 minutes.
• 1.3 – All e-consultation orders are payable immediately by credit card.
• 1.4 – All personal data will be treated as confidential by Clinique Matignon. The Facetime consultation is not recorded, but the information transmitted during the consultation will be recorded in a medical file kept by Clinique Matignon.
• 1.5 – Clinique Matignon undertakes to contact the customer within 48 hours. (working days) upon receipt of payment confirmation, in order to set up an appointment for e-consultation, provided that all the information given in the order is valid.
• 1.6 – Clinique Matignon cannot guarantee that the customer’s choice of date for the e-consultation will be respected, but will do its utmost according to availability.
• 1.7 – During an e-consultation, Clinique Matignon will under no circumstances make a medical diagnosis, but will provide advice and information in its field.
• 1.8 – In the event of cancellation by the customer, after payment, without a valid reason, no refund can be requested. A written request should be sent to shop@cliniquematignon.ch and, after consideration, a discount voucher for a treatment of an equivalent value, less processing costs, may be obtained.

Article 2 – Payment by Internet

• 2.1 – Immediate means of payment are limited to the following credit cards: VISA, MASTERCARD, PAYPAL.
• 2.2 – Clinique Matignon has entrusted its online payment system to Sixpay, a service provider specializing in secure online payments. This service provider guarantees the total confidentiality of your banking information, secured by SSL protocol, which systematically checks the validity of access rights when you pay by credit card, and encrypts all exchanges to guarantee confidentiality.
• 2.3 – PAYMENT ON INVOICE within 30 days in partnership with swissbilling.
  swissbilling AG is a service that allows you to pay for your order simply and securely by invoice.
  The invoice will be sent to you by swissbilling separately from the parcel, by e-mail or by post, depending on your choice. swissbilling services entail additional billing costs. The maximum amount for a first purchase with swissbilling is CHF 5000.00. Payment must be made within 30 days of receipt of invoice. For security reasons, the billing address and delivery address must be identical. Before accepting your order, swissbilling AG reserves the right to check your creditworthiness with the CRIF AG database in Zurich (Tel.: 044 913 50 50), www.crif.ch).

Article 3 – Order validation

• 3.1 – When you tick the box “I have read, understood and accept these terms and conditions, I would like to book an e-consultation” when choosing your payment method, you declare that you accept these terms and conditions without reservation.

Article 4 – E-consultation

• 4.1 – E-consultation via Facetime can only take place once Clinique Matignon has received the completed e-consultation order form and payment confirmation from Sixpay.

Article 5 – Practical information and regulations

• 5.1 – As a general rule, we recommend that you order your e-consultations at least. 10 days before the chosen date.
• 5.2 – During e-consultation, customers agree to respect the rules of good session.

Article 6 – Cancellation or interruption

• 6.1 – An e-consultation cannot be reimbursed or exchanged for another treatment, except in the event that the customer and Clinique Matignon are unable to agree on a date.
• 6.2 – If the e-consultation is interrupted due to a medical emergency on the part of a Clinique Matignon doctor, the customer will be offered a new appointment.
• 6.3 – In the event of interruption of the e-consultation due to a connection problem, Clinique Matignon will not be held responsible and will under no circumstances be obliged to extend the session.
• 6.4 – In the event of cancellation by the customer, after payment, without a valid reason, no refund can be requested. A written request should be sent to shop@cliniquematignon.ch and, after consideration, a discount voucher for a treatment of an equivalent value, less processing costs, may be obtained.
• 6.5 – No refunds will be made following the purchase of a subscription except in the case of medical contraindication.

Article 7 – Online sales, returns and refunds

• 7.1 We are committed to offering our customers the best possible products.
• 7.2 In principle, products are non-refundable.
• 7.3 If you feel that the products you have received from our online store do not meet this commitment, we invite you to contact our customer service department by e-mail at shop@cliniquematignon.ch.
• 7.4 We may then offer you an exchange of products.
• 7.5 Any defective product must be returned with its packaging.

Article 8 – Applicable law and place of jurisdiction

• 8.1 – These general terms and conditions of sale are governed by Swiss law. The place of jurisdiction is Neuchâtel.
